MP to table bill to stop retaliatory evictions

Brent Central's Lib Dem MP, Sarah Teather, is intending to introduce a Private Member's Bill to ban "retaliatory evictions."

In the Constitution's make up, every year backbench MPs can put forward those they feel should be allowed to table Private Member's Bills and chosen through a ballot. Sarah Teather was given the go ahead along with 19 other MP's to table their own Bills.

A housing charity's released figures claimed that  213,000 evictions had been issued after tenants had requested landlords to carry out repairs and maintenance. The figures have been blasted by the Industry as inflammatory and incorrect.
 

What is retaliatory eviction?

  • Put simply no matter how good you are as a landlord the tenant may be unreasonable and use any reason to withhold rent, You could evict using a Section 8 Notice for breach of tenancy but the tenant can use a multitude of  Tenant defence & delaying tactics
  • To avoid counter claims to block an eviction a Landlord would rely on the Section 21 Notice  to evict the Tenant,  A Section 21 Notice is part of the Accelerated Possession procedure that is mandatory possession; basically it means: I promised I would rent to my Tenant from A to B. The end date being B has now passed. I want the Tenant to leave. My paperwork is in order so the Judge has no choice but to grant possession and they MUST to leave. This is a postal process and rarely should there be a Court Hearing
 

Teather's Bill she believes will stop many cases of supposed retaliatory evictions, as she believes it is a major problem in her constituency. Central Brent has over 33,000 private rented properties and is one of the highest areas in the country with private renters.

Teather said: “It’s completely wrong that some rogue landlords evict tenants simply because they ask for repairs to be carried out.

“Everyone should have somewhere comfortable and safe to live. But all too often, tenants put up with things like damp, dangerous electrical fittings and mould because they are too scared to complain.

“This bill could make a real difference to 1.3 million renting families in England. I hope my colleagues in Parliament get behind it and turn it into law.”

It is important to note that the majority of Private Members' Bill fail to see the light of day by not getting on the statute books.
 

Compare Tenant Eviction Notices

Where the Tenant fails or refuses to leave there are only two forms of Eviction Notice to end the Tenancy. If you fail to serve a valid Notice any application made for possession will be denied
 
 
The Section 21 Notice Tenant Eviction process is easier for it is a postal request resulting in mandatory possession, whereas with the Section 8 Tenant Eviction Notice process attendance in court is required and whilst the Landlord can seek possession and damages, the outcome is far from guaranteed. see Tenant defence & delaying tactics
