Renewing a Tenancy

Firstly there is no obligation on a Landlord to renew a Tenancy agreement.

This is because the tenant has automatically gained security of tenure for at the end of the initial rental period, say 6 months, from then on the Tenancy becomes a periodic tenancy. In law this means the tenancy continues on a month by month basis for the tenant, but the landlord is obliged to serve two months notice for it is now a statutory Periodic tenancy.

There are many advantages of issuing a new agreement and some disadvantages. The first thing a landlord needs to decide is that they are happy with the tenant. If so, offer the tenant a new tenancy Print Letter, if not keep them on a periodic Tenancy for this keeps you in control. In essence do nothing for the contract automatically roles over.
