Section 21 Notice Guide

A Section 21 Notice is a Legal Notice informing the Tenant that the Landlord requires they vacate and can only be used to terminate an Assured Shorthold Tenancy (AST). A Section 21 Notice, to be valid, MUST contain pre defined legal text.

How to issue a valid Section 21 Notice

The Section 21 Notice to be served is determined by whether or not it is served before or after the last day of the Tenancy Agreement
 
You need a minimum of three copies of the Section 21 Notice, yours, each named tenant and the courts.
 
If serving the Section 21 Notice in the FIXED TERM
 
Serving the Section 21 Notice AFTER the last day of the fixed term
21 1 or (1B)

Applying for possession rules

Should the Tenant fail to vacate following the expiry of the Section 21 Notice means that the Landlord is ELIGIBLE to apply for a Possession Order.

What happens after I have made my application for a Possession?

There are a number of possibilities
 
Firstly the Tenant is sent a copy of your Section 21 application and is given 14 days notice to lodge a defence.

Always have a plan B
 
If the Tenant is also in rent arrears you should issue a Section 8 Notice for rent arrears Produce a Section 8 Notice for Rent Arrears
