Section 21 Possession by Post

Under the terms of a short hold tenancy, the landlord has an automatic or mandatory right to possession of the property at the end of the agreed term, or after 6 months if the agreed term is less than 6 months, provided the required 2 months' Section 21 Notice has been served correctly and expired.

Once you have completed the court form and submitted to the court, the court will then serve the claim on the Tenant. The Tenant will then have 14 days from the date of service to send their reply (defence) to the court stating why they oppose the claim, or seeking a postponement of possession on grounds of exceptional hardship. If the Tenant files a defence at the court then a copy of it will be sent to you
