Joining to use our eviction service We have dealt with thousands of evictions, they are time consuming and resource intensive, we reserve the right to decline acceptance of certain types of new memberships, If at the time of applying for membership ANY of the following apply you may NOT be eligible to become a member of PIMS®.   • You have already applied to court and have been notified of court hearing for Section 21Notice Eviction
  • The Tenant or their legal representative has lodged or multi track case [counter claim] for a section 8 Notice
  • An application for possession or Bailiff has been struck out or denied-
  • The landlord or Agent is not compliant with Deposit Legislation, HMO or Selective Licencing, HHSRS obligations at time of applying for possession
For the avoidance of doubt all existing members, renewing and new members will continue to be supported even in above cases, but we are declining new cases where Landlords have tried to go it alone and made a mess and then wish to join so PIMS® advisors can untangle it all. Such cases are fraught with problems and could have been easily avoided by following the PIMS® Ending a Tenancy - Eviction Flowchart where we have declined membership we recommend you contact a solicitor who specialises in Property Law

Further Exclusions for membership

  • We only accept members with properties located in England or Wales and Tenancies commencing on or after 28 February 1997. All members MUST be UK based.
  • All Letting Agents must be compliant with Data Protection Laws, operate client accounts, have professional indemnity and if in England MUST be a member of a Letting Agent Redress scheme.
  • Solicitors and Barristers As of 16th Feb 2016 we cease to accept memberships from Solicitors. However we will continue to accept Barristers provided they are representing the Landlord and not a tenant
  • If you wish to secure vacant possession to sell, for probate or assignment of lease - you are not eligible to join

Use Of PIMS Tenancy Credit Check and Tracing Service

  • We are registered with the data protection and authorised to provide Tenant credit checks on and trace individuals. In accordance with the Data Protection Act you MUST have the Tenants or Guarantors permission to perform a credit check on them, this is typically granted on the Tenancy Application Form given to the Tenant or Guarantor
  • Should you exceed your FREE allocation of credit checks [typically 10 free per year ] or debtor trace reports then you may wish to purchase more for a nominal price .

  • and site content and documents are protected by copyright laws, in addition such breech of copyright carries an unlimited liability upon the individual so we are within our rights to pursue individuals and Directors (in addition to the offending company). Reasonable use is acceptable, resale / reuse of PIMS materials for commercial or other gain contrary to our interests is not.

MEMBERSHIP PAYMENT, RENEWAL AND CANCELLATION

  • We do not hold your card payment details these are held and processed by eEPDQ which is part of Barclays Banks PLC.
  • By paying your membership by continuous card payment authority you benefit from unrestricted access to all member services, you help us reduce our administration costs therefore help us to provide a quality service at the lowest cost to our members. Membership renews on the anniversary of the first payment quarterly or annually unless requested otherwise. All memberships may be cancelled any anytime
 

General Terms

1. Definitions

PIMS® and PIMS.co.uk® are trademarked of and operated by Instant Logic Limited, Winnington Hall, Winnington, Northwich, Cheshire CW8 4DU. England.
“You” and “Your” means you the person entering into this agreement with PIMS

2. User Obligations

1. You agree that You will only access and use the Site in accordance with these terms of use and in accordance with and subject at all times to all applicable laws and regulations anywhere subsisting in the world.
2. You will not directly or indirectly act or omit to act in any way which may infringe, damage or endanger any intellectual property rights (or any goodwill attaching thereto) of PIMS or any third party which may now or in the future subsist in any part of the world and will not knowingly permit any other person to do so.
3. You will provide PIMS with accurate personal details as requested by us upon registration (where necessary) including Your full name and address and will inform us immediately of any changes to the information that You provided when registering.
4. You are responsible for maintaining the confidentiality of Your account and password and You agree to accept responsibility for all activities that occur under Your account or password.
5. You may not in any circumstances do any of the following on or in relation to the Site:
a) involve the transfer or use of any computer viruses, trojan horses, worms or anything else designed or intended to interfere with or interrupt or disrupt any computer or other systems or to secretly or covertly access, use or appropriate any data or other information or impair the functionality, interoperability or performance of this Site;
b) be offensive, menacing, abusive, defamatory, obscene, indecent or pornographic;
c) impersonate any person or entity or falsely state or otherwise misrepresent Your affiliation with a person or entity;
d) create any liability for PIMS whatsoever;
e) permit any third party to do any of the above.
6. You agree to pay the subscription according to the agreed payment schedule.

3. Intellectual Property

All contents on this Site (including text, graphics and any other material) are protected by copyright, trademarks and other intellectual property rights, which are owned or controlled by PIMS or our licensees. You agree to comply with all copyright notices, information or restrictions contained in any information accessed through this Site.

You may use the Site solely for Your own personal use. Under no circumstances are You permitted to publish, re-transmit, re-distribute or otherwise re-produce any of the content supplied to You or which appears on the Site in any format to anyone and You may not use any such content in connection with any business or commercial enterprise.

5. Security

Under no circumstances does PIMS hold sensitive payment details such as credit card numbers. All payment transactions are handled through ePDQ this is provided by Barclaycard.

6. Force Majeure

You expressly absolve and release PIMS from any claim of harm resulting from a cause beyond PIMS's control, including, but not limited to, the failure of electronic or mechanical equipment or communication lines, telephone or other interconnect problems, computer viruses, unauthorized access, theft, operator errors, severe weather, earthquakes, or natural disasters, strikes or other labour problems, wars, terrorism, or governmental restrictions.

7. Disclaimers

All links from this Site are provided for information and convenience only. PIMS cannot be held responsible for sites linked to, or the material found there or for any error, omission or inaccuracy in such material or its failure to comply with the relevant laws or regulations. 13. Term and Termination

This agreement will take effect at the time You begin using the Site (thereby indicating acceptance of this Agreement). PIMS reserves the right at any time and for any reason to deny You access to the Site or any part of it and to terminate this agreement. Termination will be effective without notice.

Should You wish to terminate your subscription with PIMS you are required to give one month’s written notice prior to renewal date to PIMS by emailing them at the following address richard @InstantLogic.co.uk. Should we feel there has been excessive use, or unreasonable expectation of level of service or abuse of the service we reserve the right to terminate any membership and at our discretion refund any unused portion of any fee paid.

14. Entire Agreement

Save in case of fraudulent misrepresentation or fraudulent concealment, these terms and conditions set out the whole of the Agreement relating to use of and access to the Site. They may not be varied by You at any time.

15. Governing Law & Jurisdiction

This Agreement shall be governed by and construed in accordance with English law. Disputes arising in connection with this Agreement shall be subject to the exclusive jurisdiction of the English courts.

16. Refunds & CANCELLATIONS

We want you to be delighted with your PIMS experience; however, we appreciate that occasionally there may be reasons why you may want to cancel your subscription where you have paid annually in advance or perhaps for technology reasons we are unable to provide you with purchased items. That is why under our 28-day satisfaction guarantee, if for any reason you are unhappy with your purchase, you can contact our on line help desk where you will be advised of any refunds due.

All memberships can be cancelled in the first 28 days after order. We reserve the right to charge an administration fee of no less than £15 but such charge is usually made where it is considered the user has derived fair value using services, downloads and or Helpldesks. We reserve the right to exclude such persons from rejoining
 
Cancellation of Membership by PIMS
 
PIMS reserves the right to refuse / cancel any membership at any given time, Examples, If there has been abuse, there is an unreasonable expectation or the Landlord or Agent are conducting themselves in an inappropriate manner [morally or legally].
 
By law, customers in the European Union have the right to withdraw from the purchase of an item within seven working days of the day after the date the item is delivered. This applies to all of our products except for digital items and services (e.g.: Online Training) where the online service has been accessed. We regret that we also cannot accept cancellations of contracts for the purchase of video, DVD, audio, products and software products where the item has been unsealed.

We reserve the right to refuse returns or to charge you our fees and expenses if the product is received otherwise than in accordance with these requirements.

What data do PIMS store on mE

The only data stored is data you have provided to us, this is held securely using password and data encryption techniques. All data is held securely at UK location

Who do you share my data with?

We do not permit any other persons/organisations access to your data. Where requested we may be required by law to provide such details – example Welfare Reform Act - prevention of fraud, Police investigations or such authorities with a lawful requirement ; for we are not permitted to interfere with such lawful rights

Examples of data we store

For all registers users we typically retain
  • Email, recipient name & Address, phone number, number of properties, we may store memos which are to assist the helpline track member queries
  • Tenant Data – Where a user of the site generates a tenancy agreement or other document we may store Tenant name, rental address, phone number, rental amount, term, deposit etc. It is the sites user’s responsibility to ensure they are fully compliant with requirements of GDPR and Data protection legislation and inform parties accordingly
  • Tenant Credit Checks – We are obliged to retain all Tenant Credit Check data and it is the site users’ responsibility to ensure they are fully compliant with requirements of GDPR and Data protection legislation. The tenant has the right to request removal of their credit check footprint by contacting Call Credit who provide the data to PIMS.co.uk

Ability to delete information

    Mydocuments - All tenancy documents generated using PIMS.co.uk are stored in MyPIMS and by pressing delete such documents may be removed. PIMS may be obliged to retain copies and backups where we may be required by law to provide such details – example Welfare Reform Act - prevention of fraud, Police investigations or such authourities with a lawful requirement

    The user may have added rental property and tenancy details in MYPIMS MY Property, so they may generate a document – such information may be deleted by pressing delete property

    You may request we delete your account details with us – but we may be required to retain information where legislation prevails – such as HMRC vat record of invoice

How long do you store my data –

    We only store information that you have added, we do reserve the right to remove without notice such information may be stored for a maximum of 7 years from date membership finishes

Payment details

    We do not hold nor retain credit card nor Direct Debit payment details, these are held by our payment processors Gocardless and Barclays Merchant Services

Security of data and PIMS right to delete information

    Whilst PIMS may store data it is the site user’s responsibility to have copies of said documents offline and store such accordingly – PIMS reserves the right to delete all documents and property tenant information for we do not offer a backup as part of our service. Document generation is intended for one-time usage only and no other terms are implied.
