The Basics Ending a Tenancy

If you have an AST, which the vast majority of Tenancies are, there are only three lawful ways you can secure possession of your property.

1) The Tenant voluntarily leaves

Known as Accelerated Possession procedure; basically, this means;

I promised I would rent to my Tenant from A to B.
The end date has now passed. I want the Tenant to leave.
A condition of this process is that you MUST have previously served a valid Section 21 Notice on the Tenant. (dwelling)
The Tenant has failed to comply with the Section 21 Notice
Only now are you eligible to apply to the court
Provided your paperwork is in order the Judge has no choice but to grant possession
The Tenant MUST vacate otherwise you are eligible to apply for a bailiff.
Caution there should never be court hearing if so you have made an error and possession is likely to be rejected (as is the case in 7 out of 10 applications)

The first step in this process is sending the Tenant letters that demonstrate your reasonable efforts to resolve the breach. Only after this action are you eligible to issue a Section 8 Notice. Such Notice must contain at least one of 17 permitted grounds for possession

Only after the Expiry of the Notice can you apply for a possession hearing apply if rent arrears apply on-line otherwise complete manual process
You will have to prepare for a Court Hearing and prepare your Landlord's Evidence
You must consider Tenants Defences delaying tactics
At the Court Hearing, provided your paperwork be in order The Judges will make their decision and should grant possession.
On the possession date the Tenants MUST vacate otherwise, you are eligible to apply for a bailiff.
