Surrender in part a party to AST wants to leave

It is not uncommon for a tenant who is a part of a group of sharers, to want to surrender their part of the tenancy. If all tenants want to leave click here

Irrespective of the reason, the tenancy cannot be surrendered in part. It is a joint agreement to which all parties must agree any amendments. Should one party leave, without consent, then they would remain liable until the tenancy is surrendered in whole "for part surrender of vacant possession" is simply not possible.

There are two solutions.

  • ALL tenants and the landlords to agree to Complete a Deed of Assignment . The outgoing party surrenders their rights, another party takes over their obligations, they are vetted and only then the landlord and remaining tenants agree. The incoming Tenant must have the opportunity to sign an up to date inventory
  • The outgoing tenant signs a letter of surrender. The landlord and tenants (including additional replacement tenant) complete a NEW AST and begin the tenancy as though from scratch.
