What is a section 21 notice for?
A section 21 notice informs the tenant that the landlord requires them to vacate. It can only be used to terminate an assured shorthold tenancy (AST) and is a prerequisite to applying for a possession order.

Can I issue a section 21 at the beginning of tenancy to ensure they leave at the end of the agreed period?
In Wales yes. In England, the rules changed as of the 1st October 2015 and a section 21 cannot be served at the beginning of a tenancy. Four months must pass first.

When can I apply for a possession order?
When the correct section 21 notice has been appropriately issued and expired, i.e. the tenant still refuses to leave and you have all your evidence gathered.

What is the success rate of section 21 notices?
7 out of 10 section 21 notices are rejected by the courts according to The Association of District Judges. This is often due to mistakes on the notice; most commonly they are dated to expire incorrectly.

Can’t I just write a letter asking the tenants to leave?
If you’re extremely confident they will leave voluntarily yes, but, a letter asking the tenant to leave would be invalid for a possession order. Applying for possession is a very lengthy process and not issuing a section 21 notice initially could set you back months.
