Rogue Agents and Landlords Database Launching April 2018

The government has confirmed that the 'threatened' rogue agent and landlord's database alongside new banning orders will be up and running on April 6th, 2018.

Last year the Housing and Planning Act 2016 announced the government's intention to introduce the database in its targeting of the minority of rogue landlords and letting agents. It will introduced in April next year after its regulations have been fully approved early next year in time for its launch date, along with the banning order offence stopping agents or landlords from letting or managing a property.

The DCLG (Department of Communities and Local Government) has just released details of those offences which will lead to being included in the 'Rogues' list and being banned from the sector.

The main offences are:

• Failure to comply with an Improvement Notice
• Failure to comply with a prohibition order
• Offences in relation to licensing of Houses in Multiple Occupation;
• Offences in relation to licensing of houses under Part 3 of Housing Act 2004
• Contravention of an overcrowding notice
• Failure to comply with management regulations in respect of HMOs
• Illegally evicting or harassing a residential occupier in contravention of the Protection from Eviction Act 1977
• Using violence to secure entry under the Criminal Law Act 1977
• Providing false or misleading information

The government has not yet stated whether the database will be made available in the public domain.
