Following a judicial review of the Right to Rent scheme, a trade association will be able to make a written statement and oral submission at the Court of Appeal.

Unsurprisingly the government is appealing against the extremely damning criticism that the High Court delivered earlier this year, saying its scheme causes racial discrimination and therefore most certainly breaches human rights.
The judicial review of the Right to Rent scheme was secured by the JCWI (Joint Council for the Welfare of Immigrants) with the trade association, the judge said that there was no doubt that landlords were actively discriminatory against non British nationals
“because of the Scheme.”
The judge also included in his statement that the landlords' actions were
“logical and wholly predictable”, in fear of the financial penalties and threatened prison sentences.
The trade association spokesperson, said: “Right to Rent has been a failure, no one has been prosecuted under the scheme but it has created a great deal of anxiety for landlords who do not want to go to prison for getting it wrong.”
He continued: “We are disappointed that the Government has chosen to appeal against what was a clear and damning verdict by the High Court.
However, we will ensure that the views of landlords are well represented as we send a message that they should not be used to cover for the failings in the UK border agencies."
Recently the JCWI, the association and the charity representing EU citizens in the UK, told Boris Johnston and Jeremy Hunt to abolish the Right to Rent scheme if they are elected as Prime Minister.
Damningly the Chief Inspector of Borders and Immigration stated that Right To Rent had
“yet to demonstrate its worth as a tool to encourage immigration compliance”.
A date for the Government’s appeal will be forthcoming.
