It does still mean that eviction processes can still be heard and ruled on in court, however bailiffs will not carry out the orders in locations undergoing the Tier 2 and 3 restrictions such as Greater Manchester, Merseyside, London, Wales and much of the north east and north west of England.
Justice Secretary Robert Buckland wrote to the bailiffs’ trade associations asking them not to proceed with physical evictions in areas undergoing the strictest of Coronavirus restrictions.
He wrote: “We would request that your members should instruct the enforcement agents working under their authorisation not to enter properties that are classified as local alert level 2 (high) or 3 (very high)."
However Buckland appreciates that the situation is “changing rapidly” and is under constant review.
Having agreed to the request by the High Court Enforcement Officers Association it effectively means that tenants who live in Tier 2 and 3 locations cannot be evicted until at the earliest on January 12th ; this is because evictions have been suspended throughout England and Wales over the Christmas period between 11th December and 11th January.
