Newham council has claimed victory in what it calls a ‘landmark case’ against a rogue landlord.
The ‘rogue’ instigated an appeal against the council’s Banning Order but his appeal was thrown out of court.
The landlord was issued with a Banning Order for breaching Newham council’s landlord licensing scheme, and is now barred from renting or have any involvement with renting out properties in Newham and across England for three years.
He was found guilty of seven offences under the Housing Act 2004 and the landlord Jahangir Hussain was found guilty of not licencing his HMO property in October 2021.
He also was found to breach six other HMO management regulations and was slapped with a £10,000 fine as well as being ordered to pay the council’s legal costs.
The council’s successful application for the landlord’s Banning Order was granted in February 2023, which started on August 16 last year and in spite of the landlord’s misguided appeal continues.
A council spokesperson says: “This Banning Order is a first for Newham and a landmark case in our campaign against rogue landlord and to protect the rights of Newham residents living in the private rented sector. We mean what we say, when tackling the scourge of rouge landlords who think they are above the law. They aren’t and we’ll track down any landlord who tries to circumvent the rules that are there to protect our residents and their housing rights.
“We have very clear guidelines, information and support available for private landlords in Newham so that they can operate their businesses while also supporting the welfare of their tenants.”
The landlords is now banned from renting out homes, any involvement with an English lettings agency and any form of property management. He is also barred from being involved in a corporate body that undertakes any of the listed activities.
Besides the Banning Order continuance, the council has also successfully secured two convictions of the landlord in the Magistrates Court for failing to comply with planning enforcement notices of his two properties in Newham.
