Why documenting matters If rent arrears later become a Section 8 claim or wider court case, hearsay is not enough. The landlord should retain copies of letters, proof of posting, proof of email where agreed, rent schedules, notes of calls, inspection records, repair history and any payment plan discussions. 2. Audit trail A strong file should contain a clean running statement of account, copies of each arrears letter in order, proof of service, notes of all responses and a chronology of events. If it is not written down and provable, it is much harder to rely on later. 3. Reasonable conduct Landlords should show structure, not drift. It is sensible to invite the tenant to explain the arrears and, where appropriate, to put forward a realistic written payment proposal. This helps demonstrate reasonable conduct without surrendering control of the case.
