If a Landlord fails to disclose specific documents to a tenant, they cannot apply to the court to evict their tenants. This is because ALL tenancies in England are now required to use a new prescribed Section 21 Notice to end a tenancy. The use of the new Section 21 Notice is subject to the following conditions such as it cannot be issued until after month 4 of commencement of tenure nor until the tenant has received the EPC, this How to Rent Guide nor the Gas Safety Certificate and any deposit received MUST have been protected within 30 days of receipt; NO LATER This How to Rent Guide may be provided to the tenant— (a) in hard copy; or (b) where the tenant has notified the landlord, or a person acting on behalf of the landlord, of an e-mail address at which the tenant is content to accept service of notices and other documents given under or in connection with the tenancy, by e-mail.
