What will I need to issue a warrant in the County Court?
The first thing you need to do, if you want to issue a warrant in the County Court, is to obtain the Form N323 (request to issue a warrant of execution). This form is available free of charge from any County Court office. You can also submit a request online for a warrant of execution, if you had originally started your claim using Money Claim Online. Log on to www.moneyclaim.gov.uk for further information.
A warrant of execution will only help if the defendant has:
- sufficient possessions at the address you gave, which can be auctioned to raise the monies owed to you; or
- sufficient funds to cover the monies you are claiming for on the warrant (to stop goods being sold).
Before the court can issue a warrant, the defendant must have:
- refused or failed to pay the amount they have been ordered to pay; or
- are at at least one month behind with their payments.
This is called 'being in arrears'.
