The Starting a Tenancy Pack consists of

  • The Tenancy Agreement  -  This defines the legal relationship between the parties. The Agreement removes ambiguity, for performance obligations and consequences for failing to comply are clearly defined and this helps minimise disputes. 
  • The Tenancy Application Form  - Where a tenant is interested in your property in our experience, they are more likely to volunteer information that may be vital at a later stage. This form details all the information you should ever require to deal with most eventualities including absconding tenants,  information and permissions to undertake references, name of proposed Guarantor. Should you fall victim to a deceptive Tenant they can be removed using the legal process "The Landlord was induced to grant a tenancy by false and misleading information" The application form becomes proof of the deception.
  • Deed of Guarantee - The guarantor is the Landlord's insurance policy against Tenant default. They pay the Landlord the rent if the Tenant defaults, and also pay the Landlord their losses, expenses or damages where the Tenant fails to carry out his obligations under the agreement.
  • Standing Order - It is always beneficial to be paid your rent by standing order rather than cheque or cash. Cash flow is more predictive and reduces your time chasing tenants for payment, there is no need to issue receipts and there is no dispute about what was and indeed if it was paid.
  • Prescribed Information as required by the Deposit Legislation and customised to the PIMS Tenancy Agreement.
  • Section 21 Notice  Where the Landlord issues an Assured Shorthold Tenancy Agreement AST the Landlord has a mandatory right to recover possession of their property after the end date specified in the Tenancy. This right only applies where a Section 21 Notice has been issued.
