Section 21 Notice Check List

With Tenant Eviction the burden of compliance is on the Landlord and the Judge MUST REFUSE possession if you have failed to abide with ALL the rules.
 
Take your time, if we spot something now we may beable to remedy - not after though
  • 7 out of 10 applications for possession using the Section 21 Notice Process are denied, mostly due to silly mistakes and non compliance
  • Double Check If you make a mistake with your Court Application Form, or fail to provide the required evidence you facilitate the Tenant filing a Tenant Defence Form in such cases in Judge will require a Court Hearing and it is highly likely your request for possession will be denied.
  • Where your application for possession is denied you will have to start whole eviction process from the begining and will cost you - 2 times court fee, a possible fine and if the Tenants are so intent no rent for during this process.
If you are satisfied your application will be valid then proceed with your court application  If unsure call your members' Helpline 

 

If you cannot answer yes to Questions 1 to 8 

your claim for possession will be invalid - and be denied or set aside
