Issuing Keys and Handover to the Tenant
Each Tenant that is named on the agreement should be given a full set of keys upon the agreement being signed. If there are three named Tenants, then three sets of keys should be provided and ideally each tenant should sign a receipt.
- Copy of the Tenancy Agreement It is important that two original tenancy agreements are produced, as both copies need to be signed by the tenant and yourself. Do not make the mistake of supplying a photocopied agreement, as both you and tenant should have an original copy. This lists all of the Tenant’s responsibilities, obligations and what you expect of them.
- Copy of the Insurance Policy: If the Tenant is responsible for causing damage, breakages or anything else to the property or its contents that is not covered by the policy or is within the policy but an excess has to be paid, then you will want to retrieve the money. The Office of Fair Trading states that you are unable to hold the tenant liable for breaching the Insurance Policy if they were not made aware of exactly what the terms of the policy stipulated.
- Copy of the Gas Safety Certificate: Upon completion of a Gas Safety check, you will have been given a few copies of the certificate by the gas fitter. The one copy that is clearly marked, as the “Tenant Copy”, must be given to the Tenant.
- Copy of EPC prior to the signing of the AST
- Restrictive Covenants: In many cases properties will have, a list of restrictive covenants, these are actions that are not allowed on the land of the property and can be found within the Title Plans.
- Some of these restrictions can include, not being able to park commercial vehicles or even caravans on the driveway, or not being able to erect a satellite dish on the property. It is more than likely that you made the Tenant aware of such restrictions, however to cover yourself fully, in case you need to, remind them of this in writing. If there is a restrictive covenant that states that commercial vehicles must NOT be parked on the driveway, then it’s best not to show the property to a “self employed tradesman”.
- Deposits Information: The Tenant or ANY other person providing a deposit [The relevant person] must receive prescribed information about where such deposit is being held. Such information whilst included in our tenancy agreement requires certain addendum be provided; such as the scheme rules and conditions. You should as a matter of course have copies to provide to the Tenant.
